Нечасно је 80% судија, мора се хапсити и разрешавати! Јелена Павловић Мирослав Живковић

Судије већ суде према Нацрту измена Закона о парничном поступку и то је само још један доказ у прилог аргументацији да су закон писали људи врло спорних и моралних и професионалних карактеристика, рекла је адвокат Јелена Павловић гостујући у емисији реч продукције Хелмкаст, заједно са колегом адвокатом Мирославом Живковићем.

На самом почетку емисије су приказана и два скандалазно и противзаконита решења која су донеле судије у парничним поступцима, према чему се види да они већ примењују будући закон, који нити је донет, нити се зна да ли ће уопште бити донет. Једно је налог за плаћање високе судске таксе под претњом пресуде због пропуштања, а друго је да судија сама одлучује о свом изузећу.

Павловићева је рекла, да за већину чланова Радне групе, изузев троје судија, уопште не зна „како су се ту нашли“. Али осврнула се управо на рад председника радне групе, судије Врховног касационог суда Драгише Слијепчевића.Тај судија Слијепчевић, који је пар пута иступио у медијима, да упозори на злоупотребе, ни једног тренутка не каже да масовних тужби не би било да постоји колективна заштита. А управо он је био у већу Уставног суда који је укинуо колективну заштиту потрошача, и није је вратио – указала је Павловићева, подсетивши да је он био и председник Уставног суда.
У вези споразума који је потписала министарка Маја Поповић са председником Адвокатске коморе Србије Виктором Гостиљцем, рекла је да је то „приватни акт“ њих двоје.

Не знам на бази чега се он усудио уопште да оде у Министарство и потписује било какав споразум у петак када је за суботу била заказана Скупштина Адвокатске коморе Београда. Не само са намером да уруши ту скуоштину, него на неки начин да артикулише незадовољство. Они су слушали главне замерке, и рекли, о-кеј, сад ћемо ми то да артикулишемо. Немојте господо ништа артикулисати, јер и даље је све што је везано за то лаж и превара – категорична је Јелена Павловић.
Њен колега Мирослав Живковић је истакао да се „не можете споразумети око нечега што је противуставно и против здравог разума“.

Зашто се тај нацрт закона израђује у тајности? Ако је нешто тако добро, зашто се ради тајно? Зашто га предлажу та волшебна, фантомска удружења? – упитао је он.
Живковић се осврнуо на условљавање суђења плаћањем такси, позвавши се на правило да „не смете да ограничавате приступ суду, које је уставно право“.

Нарочита са тим таксама. Имали смо функционалну анализу правосуђа 2014. године,у организацији Европске Уније, где се наводи да су те таксе превисоке. Само њихова висина условљава приступ суду. А шта рећи сада где ви уводите обавезу. Једна од замерки анализе коју је радила ЕУ, јесте да у Србији има доста лоших нацрта, да су они једни од главних криваца за овакво катастрофално стање у правосуђу Србије. Такође, и Европски суд за људска права, случај који се наводи је Креус против Пољске, суд наводи да не сме такса бити препрека за приступ суду – рекао је Живковић.

Он је истакао да судске таксе које се плаћају ионако не иду суду, већ у државни буџет, а одатле се даље распоређују.

Јелена Павловић је нагласила да сви они који се активно труде да буду део промена „имају озбиљног путера на глави“.

И то свако од њих појединачно, мало ко од њих се може заобићи. Тако да су њихове одлуке производ неких других циљева – казала је она.
Говорећи о судијама, рекла је да су свега 20 процената часни и поштени, а остале би, како је рекла „разрешавала истога дана“. Она је навела да службе имају податке и о корупцији у овом сектору, те треба покренути хапшења.
